Under the federal Mental Health Parity and Addiction Equity Act (MHPAEA) and the Affordable Care Act (ACA), most insurance plans that cover medical and surgical treatment are required to provide equivalent coverage for mental health and substance use disorder treatment. This means your plan cannot impose more restrictive limitations – such as higher copays, stricter prior authorization requirements, or lower visit limits – on addiction or mental health treatment than it does on comparable medical or surgical treatment. Montana state law provides additional parity protections.
